ISLAMABAD – A Constitutional bench of the Supreme Court of Pakistan on Monday rejected the request to postpone the hearing of cases related to military courts until the decision on the 26th Constitutional Amendment.
The Constitutional Bench heard the request to postpone the hearing of the case regarding the trial of civilians in military courts.
The constitutional bench also imposed fine worth Rs20,000 on former Chief Justice Jawad S. Khawaja.
Former Chief Justice of Pakistan, Jawad S. Khawaja, had filed a petition to halt the trial of civilians in military courts while senior lawyer Aitzaz Ahsan had requested that the hearing be postponed until the decision on petitions against the 26th Constitutional Amendment.
On the other hand, Chief Justice of Pakistan Yahya Afridi referred the matter regarding the formation of a Full Court to hear multiple petitions against the 26th Constitutional Amendment to the Constitutional Bench Committee.
A three-member committee, led by Justice Amin-ud-Din Khan and comprising Justice Muhammad Ali Mazhar and Justice Jamal Khan Mandokhail, will decide on the members of the Constitutional Bench that will hear the petitions against the 26th Constitutional Amendment.
